TERMS OF SERVICE FOR PRIVATE COMMISSIONS

TERMS &

CONDITIONS

Upon paying me for a commission, you are acknowledging and agreeing to the following:​

  • You are at least 18 years of age

  • You are ready and able to pay for your commission upfront. Payment plans are accepted.

  • All owners of the characters that will appear in the commission have given permission and agreed to the purchase of the commission.

  • You understand and comply with the information listed below.

ARTIST'S & CUSTOMER’S RIGHTS

  • The artist will own 100% of the rights to the commissioned artwork and can use it as the artist wishes. The artist may post or distribute commissioned work online, and make merchandising for promotion or sale. Permission is not required from the client.

  • The client has the right to request the artist not to sell merchandise of the artwork. Please make sure this is done beforehand.

  • Claiming the artwork to be customer’s is FORBIDDEN.

  • Mass resale is not allowed. The client may post their commissioned artwork on any non-commercial website, with visible credit given to the artist

  • Erasing, cutting or covering the signature is not allowed. If a clean copy is needed ask beforehand.

  • The customer may mass resell if the customer purchases the rights to the artwork they commission which can be discussed with the artist privately via email. 

  • The artist has the RIGHT to REFUSE the commission without any sort of explanation.

  • The artist has the right to raise the final price of the commission if it needs extra work in artist’s opinion. Any explanation will be given on the customer’s request.

  • The artist has the right to cancel customer’s commission if the artist does not receive any kind of response from the client within 7 days from last message the artist sent, unless the artist receives a legitimate reason from the client ahead of time. The client will receive a refund based on how much work has been completed.

  • The artist has the right to resell an adopt if the customer didn’t accomplish the full payment on time and/or didn’t send any kind of response to the artist within 7 days from last message the artist sent. The client will receive a partial refund of the paid sum if this happens.

  • Selling an adopt for a higher price than its original is NOT acceptable unless you add extra art.

  • The customer must share the low res, watermarked version on any public website, social media or blog

PAYMENT

  • All payments have to be made through Paypal ONLY.

  • All prices are in EUR (paypal will automatically convert your currency)

  • Commissions have to be paid in full within the 48 hours of the invoice being sent unless discussed with the artist beforehand. If the payment is not fulfilled, the artist will then send another notification for the payment which has to be fulfilled in 24h. If the payment is not fulfilled the artist has the right to cancel the customer’s place in the queue.

  • Payment plans are accepted. If the customer doesn’t respect the payment plan deadlines or delays the payment over 7 days the queue spot will be deleted and an incomplete version of the art piece will be delivered.

  • If the artist misses a detail that was NOT shown in the reference or noticed when the WIP sketch was sent and approved there will be an additional fee for editing it. Additional fees can go up to half of the full commission price. After a week from delivery, any other editing request will NOT be accepted.

  • Long term Live2D payment plans and payment splits are non-refundable after 14 days from payment.*

PRIVATE

ARTWORKS

  • Are NOT accepted.

  • The artist may post every artwork they made. Customer’s name can be hidden if customer asks beforehand. Artwork publication on social media can be delayed if the artwork is a gift for someone.

REFUNDS

  • If the customer's commission has not been started, a full refund will be given.*

  • If the artwork is incomplete, a partial refund will be given. The amount will be decided by the artist.

  • If the commission is complete, a refund will NOT be given.

  • If ghosted, blocked or ignored for over a week, the artist has the right to resell the unpaid adopt and give partial or no refund. The amount will be decided by the artist.

  • If a refund is requested, do not request a Paypal chargeback. Send a message about it and the artist will transfer the money back to you.

  • If a chargeback is requested direcly to Paypal even though the customer is not allowed to ask for a refund, the customer will lose all beforementioned rights to the commissioned artwork. The chargeback will be declined and Paypal will be supplied with conversations between the customer and the artist as evidence that the artist has completed work for the commissioner. The artist will have full rights to profit from the artwork anyway. Furthermore, the customer will be blacklisted for commissioning the artist again.​

DELIVERY

TIME

  • There is no specified due date for a commission for it depends on artwork complexity and detail level. If a deadline is needed it must be told to the artist beforehand and it has to be a reasonable amount of time. Fast delivery will cost extra up to 70% of the whole commission depending on the delivery request.

NFTs?

  • It’s strictly FORBIDDEN to produce, sell or gift NFTs of the artist’s art.

  • No customer has the right to produce or sell the artist’s art as NFT.

  • Commercial license doesn’t allow the customer to produce or sell the artist’s art as NFT. 

  • Any sort of NFT production, sale or alleged “possession” will be considered as theft.

  • The artist will NEVER produce any sort of Non Fungible Token, if an art piece will be found on any NFT website please report it to the artist’s attention through email or any other social media as soon as possible.

*Long-Term payment plans and Payment splits aren’t refundable after 14 days from payment. However, a priority line can be requested. Priority line is NOT guaranteed
